These regulations specify the rules under which Internet users may use the Vidid.net service.
Content posted on the Vidid.net website is available to all Internet users, unless the description of a given functionality explicitly indicates otherwise, however, full functionality of the Vidid.net website may be used only by logged-in users.
Content marked +18 may be viewed by persons who confirm that they are of legal age. (This can be done using the function in the profile).
Vidid.net service, by making its ICT system resources available, enables storage of data by Users.
Access to the content of the Vidid.net Service and use of its functionalities described in the Regulations is not subject to any fees. The condition for obtaining access to the functionality of Vidid.net is the use of a device communicating with the Internet and equipped with a commonly used Internet browser, and in the case of Users - also having an e-mail account operating on any server (other than temporary or anonymous).
The condition for obtaining access to the content and functionality of Vidid.net is the use of a device communicating with the Internet and equipped with a commonly used web browser or mobile application of the website, and in the case of Users - also having an e-mail account operating on any server (other than temporary or anonymous).
2 Definitions
Account - a webpage separated for a given User on the Vidid.net website, where information about the User's activities on the Vidid.net website is collected and presented. One User may have only one Account on the Vidid.net Service, unless Vidid.net agrees to another.
Regulations - these Rules and Regulations.
Vidid.net service - an Internet service maintained under the Vidid.net domain, which is a communication platform intended for the exchange of information, opinions and observations concerning content available on the Internet.
User - a person registered on the Vidid.net service.
Finding - a link posted by the User on the Vidid.net Service to a web page of his/her choice, together with a description created accordingly.
3 Registration on the Vidid.net service.
Registration on the Vidid.net service may be performed by any person at least 13 years old.
In order to register, a person must provide in the appropriate form available on the Vidid.net Service at least: the name under which the user intends to appear on the Vidid.net Service (login), e-mail address (other than temporary or anonymous), and password. After completing the registration form, the registrant may be asked to provide additional data or perform additional actions to Authenticate the Account. Upon completion of the registration process and, where applicable, upon successful Authentication, an email will be sent to the email address provided in the registration form indicating how to activate the Account and other information required by law.
The User gains access to the full functionality of the Vidid.net Website after providing a login and password (login).
Activation means completion of registration, at which point an agreement is concluded between the User and Vidid.net for the provision of services by electronic means under the conditions specified in the Regulations and consisting in providing the User with the possibility to use the Vidid.net service in the manner described in the Regulations with respect to a given Account.
As a result of registration, an Account is created for the User. The information on the Account may be supplemented by the User with his/her own data.
The User has access only to non-confidential information concerning the accounts of other Users.
4 Basic functionality of Vidid.net service.
Users may post Findings of their choice on the Vidid.net Service.
Each Finding is placed in the Waiting Room and presented to other Users for evaluation.
Users may evaluate a given Finding by giving it a positive vote ("+1"). A User may cast only one vote for a given Finding. A positive vote may be withdrawn. The list of voters is posted only on the computer version of the site. Only the last 5 ratings of a given content are visible.
If the Finding gets the appropriate number of votes, it will be moved to the directory maintained on the main page of Vidid.net website.
Users may comment on any Finding at any time, as well as respond to comments already posted.
Findings may also be rated after they have been posted in the directory on the Vidid.net main page.
Users may be provided with a function allowing them to comment on or rate other content posted on the Vidid.net Service, as well as a function allowing them to exchange information, opinions and observations regarding content available on the Internet.
5 Principles of using the Vidid.net service.
All actions taken by Users within the Vidid.net service, as well as the purpose of such actions, should be in compliance with applicable laws, rules of social coexistence and good morals, in particular it is prohibited for the User to provide content of an unlawful nature.
The User shall bear full responsibility for his/her actions, including for the content he/she posts on Vidid.net.
Content created by the User should be edited in a legible manner, may not be of an advertising nature and may not violate applicable laws, rules of social coexistence, good customs (including good practices) and rights of third parties, in particular may not contain:
vulgar or offensive statements, including those concerning other Vidid.net Users
Statements violating the rules of good manners and netiquette,
content propagating violence, drastic content or inciting hatred, racism, xenophobia or conflicts between nations,
content that violates personal rights (in particular image) or copyrights of third parties,
content of a pornographic nature.
It is forbidden to post on Vidid.net links to websites that contain content referred to in section 5.3 above.
By posting data, images, comments, or other content on the Vidid.net Service, the User consents to the use of such data, images, comments, or other content by Vidid.net for the purposes of operating the Vidid.net Service and by other Users for their personal use for an indefinite period of time.
Users are required to refrain from any actions aimed at manipulating the content or results of Findings on the Vidid.net Service, to refrain from spamming the Vidid.net Service, and to refrain from any actions that may hinder or interfere with the functioning of the Vidid.net Service and the use of the Vidid.net Service in a manner that is disruptive to other Users.
6 The role of the operator of Vidid.net website.
As part of the Vidid.net Service, Vidid.net shall make available to Users appropriate tools and space on the Vidid.net Service's web pages to enable them to use its functionality.
Vidid.net shall not be liable for the actions of Users within the Vidid.net Service, nor for the content of any data posted by Users on the Vidid.net Service.
Vidid.net shall not be liable for any stored data unless it is aware of the unlawful nature of such data or related activities, and in the event that it receives official notice or obtains credible knowledge of the unlawful nature of the data or related activities, it shall immediately prevent access to such data. In the event that access to the data is prevented due to the obtained reliable knowledge of its unlawful nature, Vidid.net shall notify the User within his/her Account.
In justified cases, Vidid.net may remove the Finding along with all comments if the posting of the Finding on Vidid.net violates the Terms of Service. However, Vidid.net has no obligation to verify Findings or comments.
In justified cases, Vidid.net may remove or appropriately edit content posted by Users if its posting on the Vidid.net Service violates the provisions of the Terms of Service. Vidid.net shall not, however, be obliged to verify any data posted by Users on the Vidid.net Service.
In justified cases and to the extent justified, Vidid.net may prevent the User from logging in and using the functionality of the Vidid.netl Service (temporary blocking of the Account) if the User violates the provisions of the Regulations. The User shall be informed of the above through a message within his/her Account.
Vidid.net shall make reasonable efforts to ensure the proper and uninterrupted functioning of the Vidid.net Service, but reserves the right to temporarily suspend, to the extent necessary and in justified cases, the operation of the Vidid.net Service for technical reasons or for reasons beyond Vidid.net's control. Vidid.net shall endeavor to limit the negative effects of the circumstances.
7. Privacy protection
Vidid.net processes data in accordance with the provisions of the law, including in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free flow of such data and repealing Directive 95/46/EC (hereinafter referred to as "RODO").
To the extent not covered by these Terms and Conditions, the rules of personal data processing and protection of Users' privacy are defined in the document "Privacy Policy" - available at https://vidid.net/documents/privacy-policy .
8 Complaint procedure
The User may file complaints regarding the functioning of Vidid.net website described in the Regulations.
Complaints may be reported by sending a message to the e-mail address: [email protected]
Notification of a complaint should include the name under which the User appears on the Vidid.net service, his/her e-mail address assigned to the Account and a description of the event giving rise to the complaint. If the data or information provided in the complaint requires supplementation, Vidid.net shall request the User to supplement it in the indicated scope before considering the complaint.
Complaints shall be considered within 14 days from the date of receipt by Vidid.net of a properly submitted complaint (containing the required elements and not requiring supplementation).
The User shall receive information on the manner of considering the complaint by electronic correspondence, to the e-mail address assigned to his/her Account.
9. Termination of the use of Vidid.net service.
The provision of services on the Vidid.net. is of indefinite duration, however, the User may terminate the agreement for the provision of services by electronic means under the terms and conditions specified in the Regulations at any time.
The User may submit a declaration of termination of the agreement by using the settings available in the profile or by using the contact form.
Vidid.net may terminate the agreement to provide services by electronic means immediately when:
The User violates the provisions of the Regulations, or separate regulations of other services related to Vidid.net and provided by Vidid.net accepted by the User, or.
The User provided data or made statements that are untrue, outdated, incorrect, or incomplete, or provided data of other persons.
In situations other than those specified in the above Section 9.3, Vidid.net is entitled to terminate the agreement with 14 days' notice.
The consequence of termination of the agreement is deletion of the Account that was created with the conclusion of the agreement. Deletion of the Account does not cause automatic deletion of all content posted by the User on Vidid.net; Vidid.net, subject to its rights set forth in Section 6 above, shall not in such case delete posted Finds, comments and votes cast.
10 Final Provisions
The Regulations are made available continuously on the Vidid.net website.
In the case of non-acceptance of the new Regulations, the User is entitled to terminate, on the terms and conditions specified in sections 9.1 and 9.2 above, the contract for electronic services under the terms and conditions specified in the Regulations.
In all matters not regulated in these Regulations, the provisions of generally applicable Polish law shall apply, in particular the provisions of the Civil Code, RODO and the Act on providing services by electronic means.
Unless mandatory provisions of law provide otherwise, the governing law for the entire contract for the provision of services by electronic means under the terms and conditions specified in the Regulations is Polish law.
The contract between the User and Vidid.net, the subject of which are the services provided by Vidid.net within the framework of the Vidid.net website under the conditions specified in the Regulations, shall be governed by the Polish law. Any disputes related to services provided by Vidid.net as part of the Vidid.net Service shall be resolved by competent Polish common courts. A user who is a consumer has the possibility to use an out-of-court procedure for handling complaints and pursuing claims before the Permanent Consumer Arbitration Court at the Provincial Inspector of Commercial Inspection in Lublin.
